InfoCredit online - Terms of Use

Definitions:

Clienteach natural or legal person using InfoCredit online service.
Credit Reportfull or partial information on a single company or companies delivered by InfoCredit online service.
Quick SMS expressCredit Report available only by using the SMS Premium service.
InfoCredit onlineservice used for selling credit reports via the internet.
Orderlast stage of buying process at the InfoCredit online service at which the Client is finalising the purchase of credit reports.

Privacy policy:

All personal data provided during the registration process is used for the completion of Order and is not forwarded to other institutions or to any third parties. Data collection is carried out accordingly to the Law on Personal Data Protection of 29 August 1997 /Dz. U. No 133, pos. 883 with further changes/. At the same time InfoCredit informs that, according to the Law mentioned above, each person has the right to control the processing of data about themselves, as well as its updating and modification. Upon a specified request from registered user, his/her personal data can be removed from the service only by the InfoCredit online employees.

Processing of personal data for marketing purposes is voluntary and possible only when the Client agrees to it whilst registering at the InfoCredit online .

InfoCredit puts all its effort to protect personal data from non-authorised access.

The following status regulates the InfoCredit online service, its terms and conditions. Accepting it and being 18 years of age or over is the obligatory and necessary condition of carrying out any transactions with InfoCredit.

Business activities are carried out on the base of an entry to registry No 200830 issued by Urząd Miasta Stołecznego Warszawy dla dzielnicy Mokotów (register of economic entities in the city of Warsaw, Mokotów district).

Par. 1.

The information and data contained in the InfoCredit online are obtained by InfoCredit from different sources. For the domestic reports information and data are collected from the Business and Judicial Journal B (Monitor Polski B), the National Court Register, directly from companies and partners, press publications, the Internet and other publicly available sources. For foreign reports information and data are collected directly from the databases of other companies and InfoCredit’s partners operating in other countries.

Par. 2.

InfoCredit online offers Trade Reports , containing the characteristics of Polish companies and foreign companies.

Par. 3.

Trade Reports pricelist is available at InfoCredit online . The prices of Trade Reports, in particular sold in so-called “packages”, may be individually settled accordingly to the separate contract between the Client and InfoCredit.

Par. 4.

InfoCredit online reserves the right to Trade Reports price changes. All of the information on price changes, special offers, etc. will be available at InfoCredit online web page.

Par. 5.

All prices in InfoCredit online service are given in Polish Zloty (PLN). However, there is a possibility of changing the currency into Euro(EUR) - this option is available whilst following a buying procedure.

Par. 6.

The Client can choose between following access options to InfoCredit online service: - an online payment (Payment cards and e-transfers supported by the PayU or Dotpay S.A. Settlements Centres)
- payment by points offered by InfoCredit online (purchased in advance)
- the access to Quick SMS Express through SMS Premium services

Par. 6.1

1. In order to gain access to Quick SMS Express, the Client is obliged to send a proper text message upon a specified mobile numer. This number must be active in one of the mobile networks in Poland that provides SMS Premium services
2. In response to the Premium SMS sent by the Client, the operator sends a return SMS which contents include personal access code, which must be entered in the appropriate form on the InfoCredit online site.
3. Codes deliveries and conduction of any settlements referring to this matter are provided by the Przelewy24.pl
4. InfoCredit cannot be held responsible for any undelivered SMS messages.
5. InfoCredit cannot be taken responsible for any undelivered e-mails containing a link to the report.
6. InfoCredit cannot be held responsible and has no obligation to send feedback concerning the choice of wrong number or an invalid content of the SMS Premium.

Par. 7.

Buying of points is available by making a money transfer into the InfoCredit’s bank account.

Par. 8.

An access to the purchased Trade Reports is granted for 30 days, counted from the moment of receiving positive confirmation of an inquiry at InfoCredit online.

Par. 9.

The Client is obliged to provide authentic data during the registration and in invoice form.

Par. 10.

1. The Client agrees that the Trade Report is provided by InfoCredit online for the exclusive use of the Client’s own organisation and accepts that the Client will not publish or make data available to any third party.
2. The Client agrees not to share information and data in any form which could compete with InfoCredit's services.

Par. 10.1.

Content of Par. 10a does not apply to the Client using the InfoCredit online service under the different provisions of separate agreements between InfoCredit and the Client.

Par. 11.

1. All copyrights and other intellectual property rights to all information and data presented at InfoCredit online are the sole property of InfoCredit.
2. Copying or using the data presented in Trade Reports for re-selling or making it available to third parties is strictly prohibited, unless the Client uses the InfoCredit online service under the different provisions of a separate agreemenst between InfoCredit and the Client.

Par. 12.

The Client uses provided data at Client’s own risk only and therefore InfoCredit cannot be taken responsible for the accuracy of Client’s decisions, loss of profits or any other losses resulting from Client’s use of Trade Reports supplied by InfoCredit online. Information and data contained in Trade Reports cannot be used in any Court proceedings.

Par. 13.

A sale agreement is contracted between The Client and InfoCredit: - On the basis of Client's Order , made by the buying procedure available at www.infocredit-online.pl, where InfoCredit online sales and The Client buys Trade Reports listed in the Order Form . - The agreement is concluded when the confirmation displays at the InfoCredit online site regarding a positive implementation of the Order
- An agreement may be made in the following languages: Polish or English.
- Unit prices of Trade Reports, valid at the moment of Order placement are final to The Client and to InfoCredit.
- An agreement terminates when the access period to the Trade Report elapses.

Par. 14.

According to the Act of Law dated 02.03.2000 on Protection of certain consumer rights and responsibility for losses made by a dangerous product Par. 10.1. “the Client is not entitled to withdrawal from a distance agreement regarding the services which, due to its nature, cannot be returned”, which means that due to the unique form of services provided by InfoCredit online, the Client doesn't have the right to withdrawing from the agreement with InfoCredit online.

Par. 15.

All claims regarding InfoCredit online should be in a written form and e-mailed to raport@infocredit.pl or to the postal address: InfoCredit, ul. Foksal 10, 00-366 Warszawa. The scope and the content of information contained in any Trade Report as well as its form of presentation are not subjected to claims. The Client does not have rights to claims once receives an access to the purchased Trade Report.

Par. 16.

Information contained in Trade Reports is collected and processed with maximum accuracy, however InfoCredit does not take responsibility for the reliability of sources, suppliers or correspondents' errors made whilst collecting data.

Par. 17.

InfoCredit online has a special system granting reliability of services offered, thanks to which there is a minor possibility of errors arising. However in cases of any errors’ detection, these are corrected without any unnecessary delays.

Par. 18.

In case of disclosing Client's login or password to non-authorised parties it is necessary to inform InfoCredit online service by mailing to raport@infocredit.pl . The Client is responsible for any liabilities made towards InfoCredit online service or towards InfoCredit as a company by the use of a stolen login and password until Client receives a confirmation of receiving such massage by InfoCredit.

Par. 19.

Due to the InfoCredit online security system it is advisable to enter login and password manually each time instead of using the "remember password" option at Client’s Internet browser.

Par. 20.

The Client takes full responsibility for InfoCredit's losses resulting from violation of InfoCredit online Status.

Par. 21.

In case of violation of any of the paragraphs of the Status by the Client, InfoCredit online reserves the right to block and stop providing services to the Client for a required period of time. This is done with a preceding message send to The Client's e-mail address provided at registration.

Par. 22.

InfoCredit online has a right to refuse completion of the Order without disclosing the reason.

Par. 23.

All of the issues not regulated by the Status are subjected to: The Civil Law, the Act of 02.07.2004. on Freedom of Business Activity, the Act of 18.07.2002 on Provision of Services in an Electronic Form, the Act of 02.03.2000 on Protection of Some Consumer Rights and Responsibility for Losses made by a Dangerous Product and by the Act of 29.08.1997 r. on Personal Data Protection.

Par. 24.

A proper Court solving any disputes arising from the sale agreement is the Court proper to the defendant or the Court proper to the place of agreement finalisation.

Par. 25.

The evidence of purchase, which InfoCredit is obliging to draw up, is the electronically generated VAT invoice, available at the Clients account. InfoCredit may issue a signed invoice and send it to the Client only upon the Client’s inquiry mailed to raport@infocredit.pl . The Client consents to the VAT invoice without the Client's signature.
2. The above mentioned regulations do not refer to Qucik SMS Express access through SMS Premium.

Par. 26.

This website uses Google Analytics, a web analytics service provided by Google, Inc. (Google). Google Analytics uses cookies, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google. You may refuse the use of cookies by selecting the appropriate settings on your Internet browser, however please note that if you do this you may not be able to use the full functionality of this website. By using this website, you consent to the processing of data about you by Google in the manner and for the purposes set out above.

Par. 27.

The Client placing an Order at InfoCredit online accepts the InfoCredit online Status and terms of current promotions, if they apply to the Client.

Par. 28.

The Status with later changes is valid from 15.03.2012. InfoCredit will inform its Clients of any changes via the InfoCredit online service. The Client could be informed of these changes via e-mail address provided by the Client during the registration process in InfoCredit online.
